Anthropic is being sued over Claude Max, with a proposed class action claiming the company oversold how much usage users actually get from its paid plans. The complaint, filed in federal court in Northern California on June 14, says subscribers to Claude Max 5x and Claude Max 20x may have paid for a lot more headroom than Anthropic delivered.

The plaintiff, Karl Kahn, says he moved from Claude Pro in June 2025 to Claude Max 5x in January and then Claude Max 20x in April, only to keep hitting limits and buying extra access. That complaint lands in a familiar corner of the AI business: companies love selling ”priority” and ”expanded” access, but the meter behind those words is often harder to understand than the model itself.

Anthropic positions Claude Max as a premium tier above Claude Pro. Max 5x costs about $100 a month and is advertised as offering five times more usage than Pro, while Max 20x costs about $200 a month and promises up to 20 times the limits, plus priority access to new models and more advanced workflows such as Claude Code.

The lawsuit argues that those promises are too fuzzy to verify. It claims Anthropic never clearly explained how ”usage” is measured, leaving customers unable to tell whether they are actually receiving the service level advertised on the checkout page. That is the sort of language that keeps lawyers busy and subscription users suspicious.

Why AI subscription pricing is becoming a legal problem

Anthropic is far from alone here. OpenAI, Google, and Perplexity AI all sell paid AI plans with bigger quotas or priority access, and the industry has leaned heavily on vague terms like ”expanded usage” while the underlying systems quietly change what counts as a request, a token, or a session. The bigger the model and the more expensive the tier, the easier it is for the billing story to outrun the actual limits.

The case seeks damages, refunds, an injunction against the current way the plans are described, and class-action status for users who signed up for Max 5x or Max 20x through Claude.com or the desktop app from April 2025. If the court lets it proceed, Anthropic may have to do more than defend its pricing: it may have to explain, in plain English, what a premium AI subscription really buys.
