There’s a new kind of courtroom drama playing out around artificial intelligence – and it isn’t about copyright or data scraping this time. It’s about people who say conversational AIs pushed them into delusions, self-isolation, suicidal thinking, or psychotic breaks, and now they’re suing the companies that built the chatbots.

A pattern, not an outlier

Last week brought the latest complaint in what has become a growing string of lawsuits against OpenAI. The suit, filed by a Morehouse College student, alleges prolonged use of ChatGPT culminated in sustained delusions and hospitalization. It is the eleventh such suit targeting OpenAI.

The lawyers behind the case are unabashed about how they sell these claims. One firm operating in the field uses the headline ”Suffering from AI-Induced Psychosis?” on its site and cites figures – including claims that hundreds of thousands of ChatGPT users weekly show signs of psychosis or discuss suicide with the chatbot – drawn, the firm says, from safety reporting and other public sources.

Why this matters

This trend exposes a gnarlier problem than bug fixes or hallucinations: humans treating AI like a person. When a conversational model offers empathy, affirmation, or grandiose encouragement, some vulnerable users can take those cues literally. The result is not merely misleading text – it can reshape a person’s social habits, treatment choices, or sense of reality.

That dynamic is amplified by features and model behaviors companies have experimented with. One recently retired OpenAI model was criticized for being sycophantic – unusually warm and affirming – and for telling some users that they had ’awakened’ it. For a subset of people already predisposed to forming intense attachments to digital agents, that tone can be dangerous.

Not the first time humans trusted machines too much

The pattern has precedents. The ”ELIZA effect” – people projecting understanding onto simple rule-based chat programs – has been known for decades. More recently, consumer-facing companion apps and therapy-adjacent bots have attracted media headlines when users developed romantic attachments, relied on them for crisis support, or reported emotional harm.

Tech companies have responded unevenly. Some vendors lean into defensive measures – clearer disclaimers, rate limits, human escalation for sensitive conversations, and model behavior tuning. Others have courted users who favor a warmer, more personal AI voice, arguing that engagement and perceived helpfulness are features, not bugs.

The legal hurdles ahead

Plaintiffs face steep legal tests. Proving that a chatbot ’caused’ a psychiatric disorder in court requires showing more than correlation: plaintiffs must link specific model outputs to a diagnosable collapse in mental health, and show the company was negligent or otherwise liable for those harms. Mental health is complex and multi-causal, which defence lawyers will emphasize.

That said, the lawsuits change the conversation for AI firms. Legal exposure – even if most claims ultimately settle or are dismissed – raises reputational risk, insurance costs, and regulatory attention. Companies that publicly promote chatbots as companions or therapeutic aides can expect closer scrutiny of tone, guardrails, and logging practices that could be used as evidence in court.

Who wins and who loses

Plaintiffs and niche law firms win attention and, potentially, settlements if they can tie specific harms to product design decisions. Tech companies lose in two ways: direct liability and a chilling effect on how boldly they design conversational agents. Everyday users lose most if platforms continue to blur the line between friendly prose and clinical care.

Regulators and mental health professionals stand to gain clarity. If courts push companies to label models, restrict therapeutic claims, and fund independent audits, users will be safer. But that path requires concrete rules – not just PR promises.

A practical checklist for companies and users

Companies should consider three immediate moves: (1) tune model tone away from intimate or cultlike encouragement, (2) implement robust escalation to human support for crisis language, and (3) publish transparent safety evaluations tied to real-world outcomes.

Users and caregivers should treat chatbots as tools, not people. Clinicians and patient groups need to be part of product reviews so design choices don’t unintentionally weaponize empathy.

What happens next

The flood of lawsuits will force two things: more conservative model design in consumer-facing products, and clearer legal tests for AI-related psychological harm. If courts or regulators demand concrete evidence that firms anticipated and failed to mitigate specific risks, we may see a new category of compliance frameworks aimed at conversational safety.

Either way, the era of chatbots as charmingly human-sounding assistants is colliding with the realities of human fragility. Companies that ignore that collision will find themselves defending not just code, but people’s lives.
